General Terms and Conditions

1. Scope of application

The General Terms and Conditions (GTC) of shopattack AG apply to purchase contracts with private customers and companies that are concluded via the online store. The General Terms and Conditions also extend to purchase contracts via telephone, fax, e-mail and letter. All details not expressly stipulated are regulated in the General Terms and Conditions (GTC) of the Swiss Code of Obligations (CO). shopattack AG is hereinafter referred to as the Seller.

2. Conclusion of contract

The contract is concluded on the basis of the customer’s order by completing and confirming the web order form. The automatically generated order confirmation takes place immediately after the goods in the shopping cart have been sent. With the customer’s order and acceptance by the seller, the customer undertakes to accept the goods and pay for them.

3. Prices

All prices are quoted in CHF. Shipping costs are calculated separately according to order value and/or weight. For products with a price of CHF 0.00, you will be sent a non-binding offer with the current prices. Shipping costs abroad are calculated according to expenditure and charged separately. All price information on the online store or verbal price information is non-binding and may be subject to change. Prices are subject to change by the seller at any time without notice.

4. Terms of payment

Delivery to private customers or first orders will only be made after receipt of payment. The following options are available: Credit card (MasterCard, Visa), Twint, PostFinance Card, prepayment/bank transfer (for collection on site only Twint). Payment via QR-bill is also possible – but only for existing customers who already have a customer login for the online store.

For companies, the invoice is enclosed with the delivery or sent separately by email if the delivery/invoice address differs. The invoice is payable within 10 days without deductions, after which payment shall be deemed to be in arrears. If the invoice is not paid within 10 working days despite a reminder, a second reminder will be sent and a reminder fee of CHF 20.00 will be charged. Debt enforcement proceedings will be initiated upon expiry of the set deadline. All costs such as reminder and collection fees as well as interest on arrears and other expenses plus the invoice amount shall be borne by the debtor.

Orders abroad are only processed against advance payment.

5. Terms of delivery

Deliveries are made as quickly as possible. If the seller is in default of delivery, the customer will be informed within 3 working days at the latest and notified of the expected delivery date. If the goods do not arrive within the specified period and there is no further information (e.g. new delivery date) from the seller, the customer is entitled to waive the delivery. Partial deliveries or advance deliveries require the express consent of both contracting parties.

6. Transportation risk

The customer bears the transportation risk when the goods leave our place of business. If the delivery is damaged during transportation, we recommend having a report drawn up by the transport company and informing the seller within 3 working days. Consignments of goods within Switzerland are insured by the transport company up to CHF 1,000.00.

7. Retention of title

The delivered goods remain the property of the seller until full payment has been made.

8. Right of return / right of exchange

Notices of defects or complaints regarding incorrectly or incompletely delivered goods must be made in writing within 14 days of the date of dispatch. There is no right of return for goods that were made to special customer requirements or ordered from the manufacturer exclusively for the customer. All other goods which are not listed here can only be returned or exchanged with the written consent of the seller. The goods must be returned in unopened original packaging and in perfect condition. The resulting additional costs for shipping and the transportation risk shall be borne by the buyer. The seller reserves the right to charge a one-off handling fee of CHF 20.00.

9. Warranty services

We provide a 24-month guarantee for products manufactured in-house from the day on which the goods leave our premises. The warranty for all other products is granted in accordance with the manufacturer’s warranty, which also begins on the day of dispatch. Warranty claims can be submitted to the seller at the seller’s expense upon presentation of the invoice receipt or original receipt. The seller or manufacturer decides whether the goods will be replaced, repaired or the purchase value refunded. Further claims are excluded. The prerequisite for a warranty claim is a verifiable defect that is recognized in the manufacturer’s warranty, for example due to faulty material or production errors. Any warranty is void if the buyer has made changes to the product or if the goods have been used improperly.

10. Liability

The seller rejects any liability claims. In particular, product descriptions and information, illustrations or technical data sheets of the manufacturer are without guarantee. No liability is accepted for damage caused by improper handling and use or natural wear and tear. Improper use shall also include modifications or adjustments made to the goods by the buyer.

11. Privacy policy

You can read our privacy policy here (link). These provisions are an integral part of our General Terms and Conditions. We only record the mandatory information for the order. We use these to process the order and to make the next purchase as pleasant as possible for multiple customers. We do not pass on your personal data, including your address and e-mail address, to third parties. Excluded from this are our service partners who require the transmission of data for order processing (e.g. for direct deliveries). In these cases, however, the scope of the data transmitted is limited to the minimum required. We use your inventory data exclusively for processing your order. The data required for business transactions (address details, order information, etc.) are stored on our system and used and stored securely in accordance with the Swiss Data Protection Act.

12. Jurisdiction

The place of jurisdiction for any disputes arising from these General Terms and Conditions (GTC) is the registered office of the seller. This law applies exclusively in Switzerland.
